These Terms of Service ("Terms") govern your use of www.opcao.co.uk ("the Site"), the products and services available through it, and any related communications. They form a contract between you and Opcao Ltd.
By accessing the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.
1. About us
Opcao Ltd (trading as Opção for Men) is a company registered in England and Wales under company number 15395249, with its registered office at Unit A, 82 James Carter Road, Mildenhall, Suffolk IP28 7DE, United Kingdom.

Our Site is hosted on the Shopify platform.
2. Eligibility
You must be at least 18 years old to place an order. By placing an order you confirm you are 18 or over and have the legal capacity to enter into a contract.
You must be at least 16 years old to create an account or subscribe to our marketing communications.
We may refuse to supply, or cancel, any order that we reasonably suspect has been placed by someone under 18.
3. Products
Opcao sells natural, non-medicinal personal care products designed to support intimate hygiene. Our products are cosmetics within the meaning of UK Cosmetic Products Enforcement Regulations 2013 — they are not medicines and are not intended to diagnose, treat, cure, or prevent any medical condition. If you have a specific medical concern, please consult a qualified healthcare professional before using our products.
We make every reasonable effort to display product colours, sizes, and descriptions accurately, but small variations may occur. If a product you receive is materially different from how it was described, please contact us under the Refund Policy.
We reserve the right to limit or refuse orders that, in our reasonable judgement, appear to be placed by resellers, dealers, or distributors, or where stock is insufficient. We may also restrict sales to certain geographies as set out in our Shipping Policy.
4. Orders, pricing, and payment
By placing an order, you make an offer to buy the products. The contract is formed when we send you an order confirmation email.
Prices include UK VAT where applicable. For orders delivered outside the UK, VAT and any duties are handled as set out in the Shipping Policy.
Payment is taken at the point of order. We accept the payment methods displayed at checkout.
We may correct any errors in pricing, product descriptions, or stock availability before dispatch. If a price was clearly wrong, we may cancel the order and issue a full refund — we will contact you first to give you the option to reconfirm the order at the corrected price.
5. Subscriptions
Some products are available on a recurring subscription. Subscription terms are set out in our Subscription Policy, which forms part of these Terms.

6. Delivery and returns
Delivery is governed by our Shipping Policy.
Returns and refunds are governed by our Refund Policy, which sets out your 14-day right to cancel and your rights under the Consumer Rights Act 2015.
7. Your account
If you create an account, you are responsible for keeping your login details confidential and for all activity that occurs under your account. Please contact us immediately if you think your account has been used without your permission.
We may suspend or close your account if you breach these Terms or use the Site for unlawful purposes.

You agree not to use the Site:

9. Intellectual property
All content on the Site (including text, images, logos, product designs, and the Opcao and Opção brand names) is owned by or licensed to Opcao Ltd and is protected by UK and international copyright and trademark law. You may view and download content for personal, non-commercial use only.
If you submit reviews, photos, or other content to the Site or our social channels, you grant us a non-exclusive, worldwide, royalty-free licence to use that content in connection with our business (including in marketing). You confirm that any content you submit is original, doesn't infringe anyone else's rights, and isn't unlawful, defamatory, or obscene.
10. Privacy
Your personal data is processed in accordance with our Privacy Policy. Opcao Ltd is the data controller.
11. UK consumer rights — what we can and can't exclude
Nothing in these Terms excludes or limits our liability for:
(a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; (c) any breach of the terms implied by sections 9, 10, and 11 of the Consumer Rights Act 2015 (satisfactory quality, fit for purpose, as described); (d) defective products under the Consumer Protection Act 1987; or (e) any other liability that cannot be excluded or limited under English law.
Your statutory rights as a consumer are not affected by anything in these Terms.
12. Limitation of liability
Subject to clause 11, our total liability to you for any loss or damage arising out of or in connection with these Terms or your use of the Site is limited to the price you paid for the products in the relevant order.
We are not liable for:

Loss of profit, business, revenue, or goodwill (where you are not buying as a consumer)

Indirect or consequential losses
We do not exclude or limit liability that cannot lawfully be excluded.
13. Events outside our control
We are not liable for any failure or delay in performing our obligations where that failure is caused by an event outside our reasonable control, including (but not limited to) carrier delays, supplier failures, fire, flood, pandemic, civil unrest, strike, or government action.
14. Changes to the Site or these Terms
We may update the Site or these Terms from time to time. Updated Terms apply to orders placed after the change is published — orders already placed are governed by the Terms in force when the order was placed.
15. Complaints and dispute resolution
If you have a complaint, please contact us first at info@opcao.co.uk. We aim to respond within 5 working days and resolve complaints within 28 days.
If we can't resolve your complaint, you may be able to use an Alternative Dispute Resolution (ADR) scheme. We are not currently a member of an ADR scheme, but you can find an ADR provider on the Chartered Trading Standards Institute website.
You also have the right to bring legal proceedings — see clause 17 (Governing law).
16. Termination
These Terms apply for as long as you use the Site. You can stop using the Site at any time. If you breach these Terms, we may suspend your access without notice. Termination doesn't affect any rights or obligations that arose before termination.
17. Governing law and jurisdiction
These Terms and any dispute or claim arising out of or in connection with them are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction to settle any such dispute, except that nothing in this clause prevents a consumer resident in Scotland or Northern Ireland from bringing proceedings in their local courts as permitted by law.
18. General
If any part of these Terms is found to be unenforceable, the rest remains in full force.
These Terms (together with the Privacy Policy, Refund Policy, Shipping Policy, and Subscription Policy) form the entire agreement between you and us in relation to the Site, and supersede any earlier agreements or representations.
If we don't enforce a term, that doesn't mean we've waived it.
